Terms of Service

The short version: You're buying a yearly license to run our commands/skills inside your own Claude Code + Google Ads API setup. You're responsible for your own Google Ads account, your Anthropic usage, and what the tool's proposed changes do once you approve them. We don't guarantee ad performance and aren't liable for how you use the tool against your accounts.

1. Acceptance of these terms

By purchasing or using 55Digital AI (the "Service"), you agree to these Terms of Service. If you're using the Service on behalf of an agency or company, you're confirming you have authority to bind that organization to these terms.

2. What the Service is

55Digital AI is a collection of commands, skills, and scripts that run inside Claude Code on your own computer, using:

your own Google Ads API access (your own google-ads.yaml credentials), and
your own Anthropic / Claude Code access.

We license you the software; we do not host it, run it on your behalf, or have a standing connection to your Google Ads accounts. Any read or write action against a Google Ads account happens locally, on your machine, using your own API access.

3. License grant

Subject to payment and compliance with these terms, we grant you a non-exclusive, non-transferable, revocable license to install and use 55Digital AI on computers you control, for your own advertising accounts and/or your clients' accounts that you manage. The current published price is $300/year, billed annually, with no per-seat or feature-tier restrictions on a single license. You may not resell, sublicense, or redistribute the software itself.

4. Payment, renewal, and refunds

Payments are processed by Stripe. Your license is valid for one year from the date of purchase and does not renew automatically — this is a one-time annual purchase, not a recurring subscription, and no card is charged again without you taking action. When your year is up, you may choose to manually purchase a new license at the then-current price to keep using the Service; there's no obligation to do so. If you believe you were charged in error, contact roman@55digital.online and we'll review it in good faith — refunds are handled case by case and are not automatic.

5. Your responsibilities

You are solely responsible for the security of your own Google Ads API credentials, Anthropic credentials, and any client data stored on your own machine.
You are responsible for complying with Google's own API Terms of Service and advertising policies when using the Service against a Google Ads account.
Automated or scheduled runs (e.g. negative-keyword audits) execute unattended based on rules you configure in each client's brief — you are responsible for reviewing and setting those rules appropriately.
Any change the tool proposes that requires explicit confirmation (clearly marked in each command's documentation) is only applied once you approve it — you remain responsible for that decision.
You will not use the Service to violate any law, any third party's rights, or Google's own policies.

6. Third-party services

The Service depends on third-party platforms we do not control, including Google Ads API, Anthropic's Claude / Claude Code, Google Analytics 4 API, and the Google Merchant Center API where applicable. Availability, pricing, rate limits, and behavior of those platforms are outside our control, and outages or changes on their end are not our responsibility.

7. No guarantee of results

Time-saved figures, example outputs, and results shown on our website are illustrative and based on typical usage — they are not a guarantee of the results you personally will get. Ad performance depends on many factors outside the Service's control (your account history, market, budget, competition, and your own judgment calls when approving proposed changes).

8. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce any particular advertising outcome.

9. Limitation of liability

To the maximum extent permitted by law, 55Digital, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or advertising spend, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

10. Termination

You may stop using the Service and cancel renewal at any time. We may suspend or terminate your license if you materially breach these terms (for example, by redistributing the software or using it unlawfully). Sections of these terms that by their nature should survive termination (e.g. limitation of liability) will survive.

11. Changes to the Service or these terms

We may update the Service (adding, changing, or removing commands) and these terms over time. If we make material changes to these terms, we'll update the "Last updated" date above. Continued use after a change means you accept the revised terms.

12. Governing law

These terms are governed by the laws of Poland, without regard to conflict-of-law principles, unless mandatory consumer-protection law in your country of residence requires otherwise.
